1. General Terms The services found at Pettube.com.au (also referred to as Pettube.com.au or Pettube.com.au) is provided by Toro Media. Subject to your acceptance of this Terms of Service which may be updated by us from time to time. As both an active visitor and/or a registered member of Pettube.com.au you will agree to be bound by these terms.

2. About the "Pettube.com.au" Service Pettube.com.au is an online service that facilitates sharing of information, connects people with one another and with local businesses. Pettube.com.au provides a variety of tools and resources which helps identify members to each other, help them search for local businesses as well as encourage online and offline interaction between members

3. Membership Prerequisites Members must be over the age of 13 and possess the capacity to enter into binding contracts. The Pettube.com.au service was purposely designed for all Australians residing locally or overseas

4. Membership Code of Conduct If you show some courtesy and kindness to others, you pretty much have things worked out for this section. More specifically, you should agree not to post, email or make available Content that:

Is fraudulent, misleading, false, deceiving, unlawful, harmful, abusive, threatening or defamatory
Is pornographic in nature or contains photographs of naked person(s), invasive of another's privacy, or harms minors in any way
Infringes any copyright, patent, trademark or trade secrets, or that you have no legal right to make available on the Pettube.com.au service
Contains any personal or identifying information about another person who does not want to be included or make contact with anyone who has asked not to be contacted
Contains computer viruses or any type of software code, files or programs designed to hinder, interrupt or destroy the functionality of any computer software or hardware
Constitute "spam". This is not only limited to messaging, but also Pettube.com.au forum/activities/network/local posts. You cannot inappropriately use Pettube.com.au as a broadcast medium to send or post a message to a number of people who did not ask for it or who would logically not expect it to be shown under the displayed component/category. Spammers will not be tolerated.

5. Other Membership Acknowledgements

You are responsible for all activities occurring under your login (username/email) information and hence you should not disclose this information to third parties. You agree to immediately notify us in writing of any unauthorised use of your account.
Pettube.com.au is not responsible for the storage or deletion of or the failure to delete or store any of your information posted to the Pettube.com.au service
Pettube.com.au is not responsible for the failure or part of a failure to upload to the site.
Pettube.com.au reserves the right to impose limitations, restrictions and conditions to our service from time to time, at our own discretion. This includes, but is not limited to suspending, de-activating memberships, removing, editing or moving content and images, vidoes and terminating a particular service or component on Pettube.com.au
Pettube.com.au does not and cannot completely control the quality, safety or accuracy of the content posted on our site by members and sponsors. Furthermore, we can make no representations or endorsements regarding the details. Content provided by members and sponsors on our site is their sole responsibility and Pettube.com.au shall have no obligation to review the content of sponsors or third party sites.
Although we do take measures to minimise the occurrence of incorrect or misleading content, by using our service you may still be exposed to content that is inaccurate, misleading, or otherwise objectionable and hence you cannot hold Pettube.com.au liable for any loss or damage of any kind as a result of the use of any content posted by members or sponsor/advertiser on our site for Pettube.com.au events and activities
Pettube.com.au provides event management and various other tools that will assist members and users arrange offline meetings for various events and activities. Pettube.com.au is not responsible for the supervision of these meetings or activities and is not involved in any way with the conduct of any individuals at these gatherings. Hence you unconditionally release Pettube.com.au from claims, demands and damages of every kind and nature, arising out of or in any way connected with your attendance of, or conduct of you or other people attending the activities/events planned on the Pettube.com.au service

6. Privacy Privacy concerns, regarding the profile information you enter into or upload to the Pettbue.com.au service is addressed and dealt with in accordance with our Privacy Policy. Agreeing to our Terms of Service also warrants an agreement with our privacy policy.

7. Content and Software License We will not claim ownership of your information posted through our service. However, to ensure we do not violate any rights you may have in regarding your Public Information (information you make available on any public areas of Pettube.com.au you automatically grant and you acknowledge and warrant that you have the right to grant to Pettube.com.au, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub licensable right to exercise, make use of, copy, display and distribute your Public Information in any currently known or unknown media and to prepare derivative works of, or incorporate into other works, such information. Any software that is made available, either as a download or otherwise from the Pettube.com.au service is the copyrighted work of Toro Media and/or our partners. Copying, distribution or reproduction of the software service or product is expressly prohibited, unless otherwise specified.

8. Relationship No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Terms of Service agreement between members, visitors, sponsors and Pettube.com.au.

9. Indemnity, Warranty and Liability

You agree to assume total responsibility and risk for the use of our service and/or any use of products and services offered by our sponsors/advertisers or service providers through this site
You agree that we shall have no liability whatsoever for any resulting unavailability, timeliness, reliability or security issues found on or experienced on our service or for any loss of data or transactions caused by planned or unplanned system outages. In addition, no advice or information (oral or written) obtained by you from us shall constitute any warranty
You agree that in no event shall Pettube.com.au be liable for any direct, indirect, special, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or in connection with our service, website or this Agreement or the inability to use our service, or arising out of or in connection with any attendance at activities or meetings, and the conduct of you or others at meetings or activities
You agree to indemnify and hold us and our shareholders, officers, directors, agents, employees, affiliates and third-party partners harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of your representations and warranties, or this Terms of Service, or the documents it references, your use of the Pettube.com.au service, any information provided to the service by you, or your participation with any activities displayed and initiated on the Pettube.com.au service
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of our services or this Agreement must be filed within one year after the claim or cause of action arose or be forever barred.

9. Notices, Updates and Governing Law Except when stated, any notices exchanged between members, visitors and Pettube.com.au shall be by email. Notices to Pettube.com.au can be sent to Info@pettube.com.au Members shall be sent to the email address found on the member's profile upon registration. You (the member) are responsible for keeping this information current. Pettube.com.au will not be responsible for your failure to receive notices due to incomplete, outdate, or otherwise inaccurate profile/registration information. This agreement and the relationship between you and Pettube.com.au shall be governed by the laws of the State of NSW, Australia. You will agree to submit to the personal and exclusive jurisdiction of the courts located within the State of NSW, Australia. This agreement (terms of service) constitutes the entire agreement between you and Pettube.com.au, superceding any prior agreements between you and Pettube.com.au
